Washington (AP) A group of injured Iraq war veterans is accusing outgoing V-A Secretary Jim Nicholson of breaking the law by denying them disability pay and mental health treatment.

Jim Nicholson, the former U.S. ambassador to the Vatican, succeeded Anthony Principi as secretary of Veterans Affairs. He was unanimously confirmed by the Senate on Jan. 26, 2005.

In his nomination speech, the president said Nicholson "is a patriot, a man of deep conviction who has answered his country's call many times."

The class-action lawsuit against the U-S Department of Veterans Affairs seeks broad change in the agency as it struggles to meet growing demands from veterans returning home from Iraq and Afghanistan.

The suit says the V-A has failed to provide prompt disability benefits, has not added staff to reduce wait times for medical care and has not boosted services for post-traumatic stress disorder.

The suit also charges Veterans Affairs and the Pentagon with cheating some psychologically wounded vets out of benefits by misclassifying P-T-S-D claims as pre-existing personality disorders.

VA DEPARTMENT'S MISSING LAP TOP STOLEN WITH 26.5 MILLION VETS PERSONAL INFORMATION

The Department of Veterans Affairs(VA) has recently learned that an employee, a data analyst, took home electronic data from the VA, which he was not authorized to do. This behavior was in violation of our policies. This data contained identifying information including names, social security numbers, and dates of birth for up to 26.5 million veterans and some spouses, as well as some disability ratings. Importantly, the affected data did not include any of VA's electronic health records nor any financial information. The employee's home was burglarized and this data was stolen. The employee has been placed on administrative leave pending the outcome of an investigation.

The numbers show that a Veteran has a better chance of hitting the lottery then of receiving a fair trial in the Court of Appeals for Veterans.

We have found that there is a pattern that Veterans who proceed Pro Se before the Veterans Court, because they are unable to obtain an attorney, are taken advantage of by both the Veterans Court, and the General Counsel of the VA.

Court Continues to Rape Veterans

The list is growing of Veterans that have contacted us because the VA illegally destroyed their records, or evidence they submitted in support of their claim. It is evident that such illegal "tactics" are actually an Official VA Policy.

Veterans depend on the watch dogs, the safe guards for justice, such as the Court of Appeals for Veterans, working. For a Veteran going to that Court to be able to find an Honest, Impartial Judge to enforce the law, and protect the Veterans Rights.

But does the system really work?

Are there any "Honest" Judges in the Court of Appeals for Veterans that will "Do their duty", enforce the law, and protect Veterans Rights?

Or is the Veterans Court System a farce intended to merely deceive, and appease, Veterans?

The Court of Veterans Appeals is made up of Judges that used to be VA Attorneys, such as Chief Judge Donald L. Ivers, who has covered up many a VA Crime, and has used the VA's sleazy "tactics" to cheat many a Veteran.

But the VA Court also has Judges such as Lawrence B. Hagel, who served in the Marines, and although extremely conservative, was General Counsel of the Paralyzed Veterans of America.

One would think that despite "bad eggs" such as Chief Judge Ivers, that one could find a little justice, and honesty, in the Court of Appeals for Veterans due to judges such as Hagel who was a Marine, and who actually used to fight FOR Veterans Issues.

VetsForJustice.Com founder, Billy Ray Kidwell, filed a Pro Se Petition for a Writ of Mandamus in the Court of Appeals for Veterans with Exhibits attached that prove the VA illegally destroyed his VA Claim File, lied to a Federal Judge, and committed a host of Federal Crimes.

The VA Court of Appeals for Veterans at first simply held Kidwell's Petition, not wanting to even file it, because the Petition had Exhibits attached absolutely proving the VA was committing Federal Crimes.

Kidwell kept complaining and after several weeks the Court of Appeals for Veterans did file the Petition.

Kidwell filed a Motion outlining a long pattern of corruption in the Court of Appeals, of cover-ups of crimes in the Court of Appeals for Veterans, where the Chief Judge was involved while employed by the VA as General Counsel, in destroying Veterans Records.

The Court refused to even file the Motion because it exposed corruption in their Court. So apparently the Court of Appeals for Veterans now has a "Policy" that if a Motion is "Unfavorable" to the Court, or exposes any miss-conduct by the Court, the Court will not file the Motion.

It is unheard of for a Court to refuse to even file a Pro Se Motion.

The Court should, at least, file all Motions, and then it can rule against them if it likes. And the Veteran can appeal. That's called "Due Process of Law". It's a Constitutional Right!

However clearly the Court of Appeals for Veterans feels that Veterans should have no Due Process Rights.

Kidwell's case was assigned to Judge Hagel, the former Marine, and Paralyzed Veterans Attorney, whom one would assume would care about his fellow Veterans, and have some Marine Standards as to honor, duty, and doing the right thing.

Since there were Exhibits attached to the Petition proving VA Attorneys lied to a Federal Judge one would think an Honest, Former Marine, would be out raged and ORDER the VA to explain why they lied to the Federal Court.

Instead, Judge Hagel closed his eyes, pretended not to see the Exhibits, and said NOTHING about how the VA had lied to the Federal Courts, and wrongly denied a Veteran access to the Courts.

Judge Hagel, unlike a real Marine with morals, and honor, shirked his duty, and closed his eyes, to protect his "buddies". The Chief Judge.

There is no doubt that Judge Hagel is going to rig Case 04-2447 to protect his "friends" in the VA, and the Chief Judge of his Court who is directly involved in the corruption in Kidwell's Case.

So what can Veterans really expect in the Court of Appeals for Veterans?

You can expect one criminal covering up for another!

A "Court" where lies, slick slanted fictional writing, and ignoring facts, and evidence favorable to the Veteran is the norm. It's a joke. A farce. A con-game to appease Veterans and make them think they really have a Court to go to.

What can Veterans do?

We can UNITE and make this con game very, very public. Criminals, and corrupt government officials cannot stand the light of day.

We need an honest Veterans Court not just for Bill Kidwell. But for each, and every, Veteran in America. The only way to get such a Court, and fair treatment, is to UNITE and not allow this kind of Court Hanky Panky in any case.

Every Veteran reading this article needs to write, not just their local newspaper, but EVERY NEWSPAPER THEY CAN FIND ON THE INTERNET, about the VA Corruption in THEIR Case, and the abuses in the Court of Appeals for Veterans.

If you are lucky enough not to not have been a victim, then you can help your fellow Veterans, by writing about either friends of yours who have been cheated, or cases exposed here, such as Kidwell's case.

If Veterans UNITE, and work together, we can clean up some of the filth in our government and make it better for all Veterans, as well as for our brave military returning from war.

If you serve your country you DESERVE a little honesty when you apply for benefits.

Do an internet search for newspapers in your state. Almost every one has a "Write the Editor" section. Write a letter exposing the corruption.

Write EVERY newspaper in your state!

Ask why the Veterans Court would not ORDER the VA to explain why it lied to a Federal Judge, WHEN THE COURT OF VETERAN APPEALS IS GIVEN DOCUMENTS PROVING THE VA LIED!

Ask why the Veterans Court is so corrupt when it comes to Veterans.

YOU can make a difference. YOUR letter may be the one that cleans up the Veterans Court for all other Veterans.

And get all your Veteran Friends, your family, anyone you can to write too.

Do this for your fellow Veterans. For our brave troops returning from war wounded, so they do not have to fight a new war at home, to get the benefits they earned.

We have done a number of articles here exposing the extremely corrupt Court of Appeals for Veterans, which is actually a conservative Right Wing Republican scheme, intended to deceive Veterans into believing they actually have a Court to go to, while in reality sending Veterans in endless circles exactly like the VA.

The facts are undeniable. Twelve of the thirteen judges in the Court of Appeals for Veterans were appointed by the Bush Family while only one judge was appointed by the Democrats.
